Ethics Advisory Committee

Opinion 86-18

Question

Is it proper for a presiding district court judge to permit the auction of “A Day In Court” at a school’s annual auction which would raise funds for the operation of the school and for the purchase of computers for use in the school?

Answer

It is not proper under CJC Canon 5(B)(2) for a judge to allow the auctioning of “A Day In Court” at a school auction since such would permit the using of the prestige of the office for fund raising purposes.

The Supreme Court adopted a new Code of Judicial Conduct effective January 1, 2011. In addition to reviewing the ethics advisory opinions, the following should be noted:

CJC 3.7(B)
